Your privacy is our outmost priority. We have drafted this Privacy Policy, along with our Terms and Conditions, in order to inform and communicate with you how we treat your “Personal Information” (PI), including any “Sensitive Personal Information” (SPI). PI is the data that can be used on its own or with any other accompanying information in order to be used to identify, contact, locate a particular person. SPI is personal information specifically relating to race, ethnicity, marital status, age, affiliations, health, education and such other information deemed an SPI under the Data Privacy Act of 2012.

As for our other services like Business, Finance, Legal and Medical, these are being performed for and are available only within the Philippines for Filipinos and residents of the Philippines.

We collect information from you when you register as a Partner Provider or professional from our platform (website and app), in the following manner:

1. When you download the eConsult platform (website and app);

2. When you create an account in the eConsult platform (website and app) manually or by using other services;

3. When you use the eConsult platform (website and app).

In using the eConsult platform (website and app), you may also be required to provide us your precise location data. We may likewise permit you, from time to time, to submit, upload, publish or otherwise make available to us through the platform (website and app), textual, audio, and/or visual content and information.

eConsult may also collect transaction details related to your use of the eConsult platform (website and app) including:

eConsult may process your PI for any of the aforementioned purposes and in accordance with the terms of this Policy for the duration of your contract with us and for such period as it is allowed under the law to process and retain your PI.

You may choose to restrict the collection or use of your personal information in the following ways:

1. If you withdraw the consent you have previously given and seek to terminate whatever agreement we have with you, you may inform us at any time by writing to or emailing us.

2. If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by writing to or emailing us.

 

Partner Provider’s Acknowledgement Clause

1. The information I provided is true, complete, and accurate.

2. I possess the required qualifications, have secured valid and subsisting government authorizations, and possess none of the disqualifications to practice my profession or expertise in the Philippines;

3. I am aware of my rights in relation to my personal data, including the right to access and correction, and the right to object to the processing of my personal data. I may visit www.privacy.gov.ph to learn more about my rights.

4. I am aware that I can refer to this Privacy Policy for Partner Providers at any time I wish. I am also aware that for questions or concerns, I can contact eConsult’s Data Protection Officer through [email protected].

5. I understand that the data I provided, as well as data in relation to my professional online consultation will be owned and may be retained by eConsult. 

5.1 By becoming a Partner Provider in the eConsult platform (website and app) and by submitting the information requested, I allow eConsult to manually and digitally process, collect, access, use, store, consolidate, and disclose my personal data for legitimate purposes, which are to: (a) provide professional services , (b) aid in historical, statistical, or scientific purposes for the quality improvement of services, (c) adhere to internal policies and procedures, and/or (d) comply with reporting obligations to governmental authorities under applicable laws and regulations.

6. I am aware that my personal data will be retained only for as long as necessary for the fulfillment of the purposes for which data was obtained, or for the establishment, exercise or defense of legal claims, or for legitimate business purposes, or as provided by law. It shall be disposed or discarded in a secure manner that would prevent further processing, unauthorized access, or disclosure.

7. I acknowledge that my personal data will not be shared with third parties unless (a) with my consent or when expressly authorized and/or permitted by law, and (b) with the Partner Providers specified who have agreed to ensure the confidentiality and security of my personal data. Understanding the purposes for which sharing is necessary, I consent to the sharing of my personal data in accordance with this privacy policy.

8. Further, I consent to the sharing of my personal data to the marketing team of eConsult and its affiliates for the continuous enhancement of experience and delivery of quality professional services.

9. Should I wish to unsubscribe from any of the above, I understand that I may communicate the details of the said request to [email protected].

10. I consent that the conversation as well as video and audio of my consultation through eConsult with the prospective client/user may be recorded for safety and legal purposes.

11. I wish to receive a notification of the consultation that I availed of through SMS, mobile app, and email.

I have read this form, understood its contents, and consent to the processing of my personal data. 

I understand that my consent does not preclude the existence of other criteria for lawful processing of personal data, and does not waive any of my rights under the Data Privacy Act, its IRR, and other applicable laws.

 

Necessary Personal Information Disclosure and Processing

eConsult clients will have access to the PI collected in the platform (website and app) especially those needed to be displayed in the profile section of the professional or service-provider and in issuing e-recommendations, or e-prescriptions. 

Any other information you have disclosed to the customer or client through the in-app messaging or video and audio technology will be kept strictly private and confidential between you and the customer/client. 

Staff and employees of eConsult will not be able to access such information. The in-app chat history will be retained for legal purposes and records of the Client.  If the Client and Partner Provider availed of the video technology, the video will not be recorded and no other person besides the parties are able to access the same. 

Furthermore, we may share the information or a part of the information you provide us with:

1. Ananta Solution Corp.’s staff and employees;

2. Ananta Solution Corp.’s affiliated entities which provide services or conduct data processing on our behalf, or for data centralization purposes;

3. Prospective clients to enable them to avail the services requested from the professional or service-providers;

4. Third-parties in order to provide the services requested through a partnership or promotional offering made by a third-party or that of Ananta Solution Corp., if any;

5. The general public if you submit content in a public forum or other features of our services that are viewable by the general public;

6. People whom you registered to the platform (website and app) for the processing of payments, on your behalf; and/or,

7. Vendors, Consultants, Marketing Partners and other Partner Providers who need access to certain specific information to carry out work on our behalf;

8. Law enforcement officials, government authorities, or other third parties if we believe your actions are inconsistent with this policy, if we need to protect the rights, property, or safety and security of Ananta Solution Corp. or others, or if there is a request for information by a competent authority if we believe disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal process.

PI collected from you may be disclosed to and processed by the above-mentioned parties – 

1. In the event that Ananta Solution Corp. engages its affiliated entities to provide certain services to you on the platform (website and app)’s behalf;

1.1. In such cases, Ananta Solution Corp. will only provide information to such parties on a “need to know” basis;

1.2. Ananta Solution Corp. will limit their right to use and further disclosure of your PI as appropriate in the course of their work for Ananta Solution Corp.

2. To verify the accuracy of the PI that has been provided to eConsult;

3. To detect, prevent, or otherwise address fraud, security or technical issues;

4. To comply with applicable laws, court order, governmental regulation, or if such disclosure is otherwise necessary in support of any criminal or any other legal investigation or proceeding here or abroad.

Since some of the PI you have disclosed may be further disclosed to Ananta Solution Corp.’s affiliated entities, Ananta Solution Corp. will exercise all reasonable endeavors to ensure that such parties keep your personal information secure.

 

Personal Information Protection

eConsult acknowledges and values your PI, most especially certain Sensitive PI that you may disclose to us, such as but not limited to, government-issued IDs, certifications, other data relevant to the practice of your profession. It is for this reason that we strive to maintain the confidentiality, and integrity of your PI.

We are committed to ensuring that your information remains private, protected and secure in accordance with Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012, its Implementing Rules and Regulations and other issuances of the National Privacy Commission. 

We implement a variety of security measures when a user enters, submits, or accesses their information to maintain the safety or your personal information. We also train our employees to properly handle your information.

All the information that we collect, as above mentioned, are stored in our cloud and back-up servers that are equipped with up-to-date and top-of-the-line computer safeguards such as firewalls, data encryption procedures and physical and digital access limitations.

Your PI is contained behind secured networks and is only accessible by a limited number of authorized persons who have special access rights and credentials to such systems. These people are required to keep the information and data confidential, as they were required to sign a notarized Non-Disclosure Agreement. In addition, all sensitive information you provide us is encrypted via the proper and appropriate procedures. Your PI is also protected by our up-to-date system and software as well as our top-of-the-line encryption settings.

Ananta Solution Corp. has specific policies and procedures to prevent whatever type of data breach and unauthorized access in your PI. We regularly test, assess and evaluate the effectiveness of the security measures of the systems that are in use. We continuously review and enhance our security policies and security measures to consistently maintain a high level of security.

Members of Ananta Solution Corp., such as developers, administrators shall uphold the utmost confidentiality in handling your PII. Ananta Solution Corp. binds its employees and consultants to a notarized Non-Disclosure Agreement, even extending beyond their contractual relations.

Whenever we engage with other companies to provide services for us and on our behalf, we require them to protect your PI and SPI, as aligned with our security standards and with applicable laws. 

Furthermore, since some and/or part of our services remains outsourced, employees of Ananta Solution Corp.’s partners are likewise bound by a notarized Non-Disclosure Agreement and Strategic Alliance Agreement in handling your PI.

Due diligence is regularly conducted by Ananta Solution Corp.’s officers in order to ensure that our partners who process the services and transactions faithfully implement the proper security measures. 

Only authorized officers and employees of Ananta have access to the personal information collected in this platform (website and app) which may be exchanged though email or by hard copy. 

In order to prevent unauthorized access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

All transactions are processed through a payment gateway provider (DragonPay, Paypal) and are not stored or processed on our servers.

Your PI shall be retained for as long as the purpose for which it was collected, and such other purposes that you may have consented to, from time to time, remains in effect. It will be retained until such time as it is no longer required nor necessary to keep your information for any other legal, regulatory or business purpose. We undertake to delete your personal information within 5 years from the time that the information is no longer necessary pursuant to the above mentioned conditions. 

 

Third-party Disclosure

We assure you - eConsult will not sell, distribute or lease your PI to unauthorized third parties unless we have your consent and/or permission or are required by law to do so. We may release information when its release is appropriate to comply with the law, enforce our policies, protect ours and others’ rights, safety and security.

Furthermore, your non-personally identifiable visitor information may be provided to other parties for marketing, advertising and/ or other promotional uses. We may send you promotional information about third parties which we think you may find interesting.

Client’s Acknowledgement Clause

1. The information I provided is true, complete, and accurate.

2. I am of legal age with full legal capacity to enter into and give lawful and valid consent to any agreement, including the transactions and consents subject hereof, for myself and/or for those under my parental authority or guardianship;

3. I am aware of my rights in relation to my personal data, including the right to access and correction, and the right to object to the processing of my personal data. I may www.privacy.gov.ph to learn more about my rights.

4. I am aware that I can refer to this PRIVACY POLICY FOR CLIENTS at any time I wish. I am also aware that for questions or concerns, I can contact eConsult’s Data Protection Officer through [email protected]

5. I understand that the data I provided, as well as data in relation to my professional online consultation will be owned and may be retained by eConsult. 

a. By becoming a User/Client of eConsult and by submitting the information requested, I allow eConsult to manually and digitally process, collect, access, use, store, consolidate, and disclose my personal data for legitimate purposes, which are to: (a) provide professional services , (b) aid in historical, statistical, or scientific purposes for the quality improvement of services, (c) adhere to internal policies and procedures, and/or (d) comply with reporting obligations to governmental authorities under applicable laws and regulations.

6. I am aware that my personal data will be retained only for as long as necessary for the fulfillment of the purposes for which data was obtained, or for the establishment, exercise or defense of legal claims, or for legitimate business purposes, or as provided by law. It shall be disposed or discarded in a secure manner that would prevent further processing, unauthorized access, or disclosure.

7. I acknowledge that my personal data will not be shared with third parties unless (a) with my consent or when expressly authorized and/or permitted by law, and (b) with the Partner Providers specified who have agreed to ensure the confidentiality and security of my personal data. Understanding the purposes for which sharing is necessary, I consent to the sharing of my personal data in accordance with this privacy policy.

8. Further, I consent to the sharing of my personal data to the marketing team of eConsult and its affiliates for the continuous enhancement of experience and delivery of quality professional services.

9. Should I wish to unsubscribe from any of the above, I understand that I may communicate the details of the said request to [email protected]

10. I consent that the conversation as well as video and audio of my consultation through eConsult with the registered professional or Partner Provider may be recorded for safety and legal purposes.

11. I may receive a summary of the consultation that I availed of through SMS, mobile app, and email.

I have read this form, understood its contents, and consent to the disclosure and processing of my personal information, including sensitive personal information. 

I understand that my consent does not preclude the existence of other criteria for lawful processing of personal data, and does not waive any of my rights under the Data Privacy Act, its IRR, and other applicable laws.

 

Necessary Personal Information Disclosure and Processing

eConsult professionals and Partner Providers will have access to the PI or SPI collected in the platform (website and app) especially those needed to be displayed in the profile section of the user or client. 

Any other information you have disclosed to the professional or Partner Provider through the in-app messaging or video and audio technology will be kept strictly private and confidential between you and the professional or Partner Provider. 

Staff and employees of eConsult will not be able to access such information and those who may have access have signed non-disclosure agreements to keep that information confidential and access it only when compelled by the law and by a unanimous decision of the Ananta Solution Corp. Board of Directors. The in-app chat history will be retained for legal purposes and records of the Client.  If the Client and Partner Provider availed of the video technology, the video will not be recorded and no other person besides the parties are able to access the same. 

Furthermore, we may share the information or a part of the information you provide us with:

1. Ananta Solution Corp.’s staff and employees;

2. Ananta Solution Corp.’s affiliated entities which provide services or conduct data processing on our behalf, or for data centralization purposes;

3. Professionals or Partner Providers to enable them to provide you the services you have requested;

4. Third-parties in order to provide the services requested through a partnership or promotional offering made by a third-party or that of Ananta Solution Corp., if any;

5. The general public if you submit content in a public forum or other features of our services that are viewable by the general public;

6. People whom you registered to the platform (website and app) for the processing of payments, on your behalf; 

7. Vendors, Consultants, Marketing Partners and other Partner Providers who need access to certain specific information to carry out work on our behalf; or,

8. Law enforcement officials, government authorities, or other third parties if we believe your actions are inconsistent with this policy, if we need to protect the rights, property, or safety and security of Ananta Solution Corp. or others, or if there is a request for information by a competent authority if we believe disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal process.

PI collected from you may be disclosed to and processed by the above-mentioned parties – 

1. In the event that Ananta Solution Corp. engages its affiliated entities to provide certain services to you on the platform (website and app)’s behalf;

• In such cases, Ananta Solution Corp. will only provide information to such parties on a “need to know” basis; 

• Ananta Solution Corp. will limit their right to use and further disclosure of your PI as appropriate in the course of their work for Ananta Solution Corp.

2. To verify the accuracy of the PI that has been provided to eConsult;

3. To detect, prevent, or otherwise address fraud, security or technical issues;

4. To comply with applicable laws, court order, governmental regulation, or if such disclosure is otherwise necessary in support of any criminal or any other legal investigation or proceeding here or abroad.

Since some of the PI you have disclosed may be further disclosed to Ananta Solution Corp.’s affiliated entities, Ananta Solution Corp. will exercise all reasonable endeavors to ensure that such parties keep your personal information secure.

 

Personal Information Protection

eConsult acknowledges and values your PI, most especially certain Sensitive PI that you may disclose to us. It is for this reason that we strive to maintain the confidentiality, and integrity of your PI.

We are committed to ensuring that your information remains private, protected and secure in accordance with Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012, its Implementing Rules and Regulations and other issuances of the National Privacy Commission. 

We implement a variety of security measures when a user enters, submits, or accesses their information to maintain the safety or your personal information. We also train our employees to properly handle your information.

All the information that we collect, as abovementioned, are stored in our cloud and back-up servers that are equipped with up-to-date and top-of-the-line computer safeguards such as firewalls, data encryption procedures and physical and digital access limitations.

Your PI is contained behind secured networks and is only accessible by a limited number of authorized persons who have special access rights and credentials to such systems. These people are required to keep the information and data confidential, as they were required to sign a notarized Non-Disclosure Agreement. In addition, all sensitive information you provide us is encrypted via the proper and appropriate procedures. Your PI is also protected by our up-to-date system and software as well as our top-of-the-line encryption settings.

Ananta Solution Corp. has specific policies and procedures to prevent whatever type of data breach and unauthorized access in your PI. We regularly test, assess and evaluate the effectiveness of the security measures of the systems that are in use. We continuously review and enhance our security policies and security measures to consistently maintain a high level of security.

Members of Ananta Solution Corp., such as developers, administrators shall uphold the utmost confidentiality in handling your PI. Ananta Solution Corp. binds its employees and consultants to a notarized Non-Disclosure Agreement, even extending beyond their contractual relations.

Whenever we engage with other companies to provide services for us and on our behalf, we require them to protect your PI and SPI, as aligned with our security standards and with applicable laws. 

Furthermore, since some and/or part of our services remains outsourced, employees of Ananta Solution Corp.’s partners are likewise bound by a notarized Non-Disclosure Agreement and Strategic Alliance Agreement in handling your PI.

Due diligence is regularly conducted by Ananta Solution Corp.’s officers in order to ensure that our partners who process the services and transactions faithfully implement the proper security measures. 

Only authorized officers and employees of Ananta have access to the personal information collected in this platform (website and app) which may be exchanged though email or by hard copy. 

In order to prevent unauthorized access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

All transactions are processed through a gateway provider (DragonPay, Paypal) and are not stored or processed on our servers.

Your PI shall be retained for as long as the purpose for which it was collected, and such other purposes that you may have consented to, from time to time, remains in effect. It will be retained until such time as it is no longer required nor necessary to keep your information for any other legal, regulatory or business purpose. We undertake to delete your personal information within 5 years from the time that the information is no longer necessary pursuant to the abovementioned conditions. 

 

Third-party Disclosure

We assure you that eConsult will not sell, distribute or lease your PI to unauthorized third parties unless we have your consent and/or permission or are required by law to do so. We may release information when it’s release is appropriate to comply with the law, enforce our policies, protect ours and others’ rights, safety and security.

Furthermore, your non-personally identifiable visitor information may be provided to other parties for marketing, advertising and/ or other promotional uses. We may send you promotional information about third parties which we think you may find interesting.

 

Cookies

A cookie is a small file which asks permission to be placed on your computer’s hard drive. The term cookie describes a range of technologies, including (1).  Pixel tags (2) mobile device identifiers, and (3) web storage used in desktop softwares or mobile devices.  Once you agree, the cookie helps analyze web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

We use traffic log cookies to identify which pages are being used.
